These Terms of Service ("Terms") govern your use of the WebFlames website and the professional services offered by WebFlames ("we", "us", "our"), a digital agency based in Lebanon. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website at web-flames.com or entering into a service agreement with WebFlames, you confirm that you:

  • Are at least 18 years of age or have parental/guardian consent
  • Have the legal authority to enter into a binding agreement
  • Have read, understood, and agree to these Terms in full

If you do not agree to these Terms, please do not use our website or services.

2. Our Services

WebFlames provides digital services including but not limited to:

  • Web design and development
  • Mobile application development
  • Custom software development
  • Digital marketing and SEO
  • Cybersecurity consulting and auditing
  • Data analysis and business intelligence
  • Web hosting and infrastructure management

The specific scope, deliverables, timeline, and pricing of services are defined in individual project proposals or service agreements ("Project Agreement") entered into with each client. These Terms apply in conjunction with any such Project Agreement.

3. Client Obligations

To enable us to deliver services effectively, you agree to:

  • Provide accurate, complete, and timely information and materials required for the project
  • Designate an authorised point of contact for project communications and approvals
  • Review and provide feedback on deliverables within agreed timelines
  • Not use our services for any unlawful, fraudulent, or harmful purpose
  • Not infringe upon the intellectual property rights of any third party

4. Payment Terms

Payment terms are defined in your Project Agreement. Unless otherwise agreed:

  • A deposit (typically 50%) is required before project commencement
  • Remaining balance is due upon project completion or as per milestone schedule
  • Invoices are payable within 14 days of issuance
  • Late payments may incur a 2% monthly interest charge
  • All prices are quoted in USD unless otherwise stated
  • Hosting and recurring service fees are billed monthly or annually as agreed

Work may be paused or withheld if payments are significantly overdue, without waiving our right to full payment.

5. Intellectual Property

Client-Owned Materials

Content, logos, trademarks, and materials provided by the client remain the client's property. You grant WebFlames a non-exclusive licence to use these materials solely to perform the agreed services.

WebFlames Materials

Upon receipt of full payment for a project, WebFlames transfers ownership of the final custom deliverables (e.g., custom-coded website, application, designs created specifically for you) to the client. However, WebFlames retains ownership of:

  • Pre-existing tools, frameworks, libraries, templates, and proprietary code developed independently
  • General methodologies, know-how, and development processes
  • Third-party components used under open-source or commercial licences

Portfolio Rights

WebFlames reserves the right to display completed work in our portfolio and marketing materials unless the client requests confidentiality in writing prior to project commencement.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This obligation survives project completion. We will not disclose your business information to third parties without your consent, except where required by law.

7. Limitation of Liability

To the fullest extent permitted by applicable law, WebFlames shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from your reliance on information provided on our website
  • Third-party service failures, outages, or data breaches beyond our control

Our total liability arising out of or related to any project shall not exceed the total fees paid by you to WebFlames for that specific project in the preceding 12 months.

8. Warranties & Disclaimers

WebFlames warrants that services will be performed in a professional and workmanlike manner. However, we make no warranty that:

  • Our website will be uninterrupted, error-free, or free of viruses
  • Any specific business outcome or result will be achieved
  • Third-party services or integrations will remain available or unchanged

The website and all information on it are provided "as is" without warranty of any kind, express or implied.

9. Termination

Either party may terminate a project engagement with written notice. Upon termination:

  • Work completed up to the termination date is billable at the agreed rate
  • The deposit and fees paid for completed milestones are non-refundable
  • We will deliver any completed work product upon receipt of outstanding payments

We reserve the right to immediately terminate services if a client engages in abusive behaviour, violates these Terms, or fails to pay outstanding invoices.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lebanon. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lebanon.
